In the legal action, Bejav Furniture Limited is requesting the court to mandate Jumwa to remit Ksh 60 million, which is stipulated in the sale agreement.
The lawsuit indicates that the former CS submitted a bid for the house, appraised at a quarter of a billion shillings, just four months following her inauguration as CS on October 27, 2022.
The property in question was previously owned by Roselyn Wambui.
The court has been informed that Jumwa successfully negotiated the purchase price from Ksh 250 million down to Ksh 215 million.
She stated that of the remaining balance not covered by bank financing, she paid Ksh 10 million and pledged to settle the outstanding Ksh 60 million within a year.
“The issue of the 12 months was agreed upon and was even captured in the shared first draft agreement. It was clear and completely uncontested that the price of the house was Ksh 215 million,” Wambui informed the court.
Wambui transferred the house to Jumwa and the house was then listed as collateral for the KCB Bank Kenya loan.
Since then, she has written multiple demand letters to Jumwa asking her to pay off the remaining balance, all of which have been ignored.
Wambui now wants Aisha to pay the amount in addition to an 18.5 per cent interest.
On her part, Jumwa has asked the court to dismiss the case saying that the court does not have jurisdiction to hear and determine the matter.
